Why residents
are challenging
the approval.

In Kelso et al. v. City of Chattahoochee Hills, residents are asking the court to examine whether the City followed the required legal process when it approved the Merrill Park rezoning on April 9, 2026.

The residents’ petition raises concerns about public review, closed-session procedures, the information available before approval, and changes to protections along Cochran Mill Road.

This fundraiser supports that legal challenge. The court has denied the City’s motion to dismiss; the underlying claims remain to be resolved.

01 / PUBLIC REVIEW

A meaningful opportunity to be heard

Residents question whether significant approval conditions were available for public review before the vote.

02 / INFORMED DECISIONS

Understand the impacts

The petition raises concerns about the studies and supporting analysis available before the rezoning was approved.

03 / TRANSPARENCY

Accountability in the process

Residents challenge aspects of the executive-session record and the process used to change scenic corridor buffers.

These are the residents’ allegations and concerns, rather than findings by the court. Case reference: Fulton County Superior Court, Civil Action No. 26CV006801.
